The purpose of this report is to analyzwe the content of 26 different process evaluations of drug courts across the country using a lessons learned approach. The stress is not on simple descriptions of the reports or the programs but on key development. In particular, this report focuses on the following:

Section I: Issues and problems in implementation.

This section summarizes the major issues in implementation being reported by the drug court evaluators.

Section II: Notable programmatic strengths and practices.

This section identifies some notable programmatic practices reported in the evaluations.

Section III : Intermediate outcomes and measurement/evaluation issues

This section discusses some intermediate outcomes that were reported and discusses issues of measurement and evaluation in drug court research.

Section IV: Lessons learned and recommendations

This final section summarizes some of the lessons that can be learned from these reports to help guide new courts in implementing drug court programs.

Preface

This report addresses a variety of issues associated with establishing and managing a drug night court. We sought answers to a variety of questions about how to recruit and retain staff for such courts, about whether night courts can be as efficient as day courts, and about whether the quality of justice dispensed at night compares favorably with day courts. We addressed these questions using a variety of methods. Because Cook County , Illinois , had the Nation’s only currently operational drug night court, we concentrated most of our efforts there. Officials graciously assisted us by granting lengthy interviews, giving us access to court records, allowing us to survey their staff about working conditions at night, and allowing us to conduct extensive observations in both day and night courts.

Executive Summary

In October 1999, National TASC (Treatment Accountability for Safer Communities), in cooperation with the Office of Justice Programs, Drug Courts Program Office and the Substance Abuse and Mental Health Services Administration, Center for Substance Abuse Treatment, developed and distributed a questionnaire designed to describe substance abuse treatment services and other treatment services currently used by adult drug courts and to identify significant issues faced by adult drug courts in obtaining and delivering high-quality comprehensive treatment services. Surveys were distributed to 263 operating adult drug courts, and 212 courts (81 percent) responded.

The drug court is information driven. The diverse nature and scope of its information needs far exceed those of the typical criminal court. In striving for optimal effectiveness, the drug court team must collect, quickly retrieve, communicate about, and react to information that supports operational decisionmaking. In the drug court context, operational decisionmaking is guided by a sense of shared responsibility among, at a minimum, the court, prosecution, defense, and treatment communities. Drug court information spans program admission and treatment issues as well as information associated with ongoing judicialsupervision of participants.
